TERMS AND CONDITIONS OF SALE

Preamble

The website bonnemaison.fr (hereinafter referred to as "the Site") is published by CHUBERB, a simplified joint-stock company (SAS) with a capital of 240,000 euros, whose registered office is located at 34 rue Sommeiller, 74000 Annecy (France), registered with the RCS of Lyon under number 788 747 780, and with intra-community VAT number FR35 788 747 780 (hereinafter "CHUBERB Company").

All orders placed on the Site are subject to these General Terms and Conditions of Sale (GTC). CHUBERB Company reserves the right to modify them at any time. The applicable GTC are those in force at the time of the order.

The Client's acceptance of the GTC is materialized by checking the box: "I accept the general terms and conditions and the privacy policy". The Client declares to have the legal capacity to contract or to be validly represented.

1. Customer Account

To place an order, the Client must create a Customer Account by registering their accurate and complete personal data. They undertake to update them in case of modification. In case of an error in the contact details, CHUBERB Company cannot be held responsible for the impossibility of delivering the order.

2. Products

The products offered for sale are described and presented with the greatest care on the Site, within the limits of available stock. These products do not benefit from a contractual guarantee; only legal guarantees are applicable.

CHUBERB Company takes the utmost care in the presentation and description of these products to best inform the Client. However, in case of non-conformity of the delivered product compared to its description on the Site, the Client may exercise their right of withdrawal.

3. Order

The order is validated when the Client confirms their cart and proceeds to payment. This validation constitutes a sales contract.

CHUBERB Company reserves the right to refuse any order from a Client in case of a dispute or non-compliance with these GTC. An order confirmation is sent by e-mail.

4. Price and Payment

The prices of the products (a product designating one or more pairs of socks) are indicated in euros, all taxes included (TTC) for the European Union, excluding shipping costs.

For deliveries outside the EU, prices are indicated exclusive of tax and cannot be subject to VAT deduction. The Client acknowledges that they are considered the official importer and that, depending on the country of delivery chosen at the time of the order, they may have to pay customs duties and/or import taxes according to the legislation in force in said country.

CHUBERB Company reserves the right to modify its prices at any time, but products will be invoiced based on the rates in force at the time of order validation by the Client, subject to availability.

Products remain the property of CHUBERB Company until full payment of the price.

Products are payable in full at the time of order. Payment can be made by credit card, Google Pay, Apple Pay, PayPal, Bancontact, Klarna, Twint or any other secure payment method offered on the Site, via the Stripe platform (SSL protocol). No banking data is retained by CHUBERB Company.

5. Delivery

Orders are shipped within 72 business hours after receipt of payment. Delivery is made to the address indicated by the Client.

For delivery to be made as quickly as possible, the Client must ensure that they have provided accurate and complete information regarding the delivery address (street number, building, staircase, access code, intercom, etc.). CHUBERB Company cannot be held responsible for any entry errors and the consequences in terms of delay or delivery error.

The transfer of risks occurs upon receipt of the package by the Client or a designated third party. In case of a delivery delay exceeding 15 days, excluding cases of force majeure, the Client may cancel their order by registered letter with acknowledgment of receipt and obtain a refund within 14 days.

In case of a damaged package, the Client must notify the carrier and CHUBERB Company as soon as possible.

6. Right of Withdrawal

In accordance with Article L221-18 of the Consumer Code, the Client has a period of 14 days to exercise their right of withdrawal without cause, starting from the receipt of the order.

The return of products is at the Client's expense to the following address:

Products must be returned in their original packaging, unworn, unwashed and accompanied by the order number. For hygiene reasons, the hangtag must have remained sewn on.

Refund: CHUBERB Company will refund the Client within 14 days of receiving the return, including initial shipping costs (excluding express options) if they were charged.

Standard withdrawal form: available in the appendix to these GTC in accordance with Article R221-1 of the Consumer Code.

7. Legal Guarantees

The Client benefits from the legal guarantees provided for in Articles L217-3 and subsequent of the Consumer Code and 1641 and subsequent of the Civil Code.

Legal guarantee of conformity: The Client has two years from the delivery of the goods to act. They can choose between repair or replacement of the non-conforming goods.
Guarantee against hidden defects: The Client can request the cancellation of the sale or a price reduction if a hidden defect makes the product unfit for its intended use.

8. Protection of Personal Data

Personal data collected on the Site is processed by CHUBERB Company, the data controller, in accordance with Regulation (EU) 2016/679 (GDPR) and the amended French Data Protection Act.

The Client has the right to access, rectify, erase, restrict, object to, and port their data, which they can exercise at the following address: contact@bonnemaison.fr.

Data is kept for the period necessary for managing the commercial relationship and may be transmitted to technical service providers involved in the order and delivery process.

9. Consumer Mediation

In the event of an amicable dispute not being resolved, the Client may use the consumer mediator relevant to CHUBERB Company free of charge:

11. Applicable Law and Jurisdiction

These GTC are governed by French law. In the event of a dispute, only French courts will have jurisdiction. If the Client is a consumer residing in another Member State of the European Union, they may initiate proceedings before the courts of their place of residence.
